This store is operated by Cotton Candy Custom Creations & Gifts (“we,” “us,” or “our”). By accessing or using the store, browsing, or placing an order, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the store.

You must be at least the age of majority in your place of residence, or using the store with the involvement of a parent or guardian, to place an order. If you create an account, you are responsible for maintaining the confidentiality of your login details and for all activity under your account. Please notify us promptly of any unauthorized use.

We try to display our products, colors, and details as accurately as possible. Because our items are handmade, slight variations in color, texture, and finish are normal and are not defects. Your device's display may also affect how colors appear. We do not warrant that product descriptions or other content are complete, current, or error-free.

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order, to limit quantities, and to correct any errors in pricing or descriptions, even after an order has been submitted. Prices, products, and availability may change at any time without notice. If we cancel an order you have already paid for, we will issue a refund for that order.

Payment is processed securely by our third-party payment provider. By submitting payment information, you represent that you are authorized to use the payment method and you authorize us (through our provider) to charge the total amount of your order, including taxes and shipping where applicable. Applicable taxes are calculated based on your delivery destination and shown before you confirm your order.

Personalized and made-to-order items are produced based on the details you submit, such as names, dates, spelling, and color choices. Please review your details carefully before completing your purchase — we create these pieces exactly as submitted, and they are generally final sale. Shipping timelines shown on the store are estimates and are not guaranteed. Title and risk of loss for physical items pass to you once we hand the order to the carrier. International orders may be subject to import duties, taxes, and customs fees that are the recipient's responsibility, as described on our Shipping page.

Returns, exchanges, and refunds are governed by our Returns & Refunds policy, which forms part of these Terms. Personalized, made-to-order, and digital items are generally final sale except where they arrive damaged, defective, or incorrect.

When you provide personalization details, reviews, photos, or other content, you represent that you have the right to do so and that the content does not infringe anyone's rights or violate any law. You grant us a non-exclusive, royalty-free license to use that content as needed to fulfill your order and operate the store. We may decline to produce any personalization that is unlawful, infringing, offensive, or that we otherwise reasonably choose not to make.

All content on this store — including designs, product images, text, graphics, and logos — is owned by or licensed to Cotton Candy Custom Creations & Gifts and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.

You agree not to use the store for any unlawful or prohibited purpose, including attempting to interfere with its security or operation, accessing data not intended for you, introducing malicious code, or using automated means to scrape or place fraudulent orders.

To the fullest extent permitted by law, the store and our products are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

To the fullest extent permitted by law, Cotton Candy Custom Creations & Gifts and its owners and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from or related to your use of the store or products. To the extent we are found liable, our total liability for any claim will not exceed the amount you paid for the order giving rise to the claim. You agree to indemnify and hold harmless Cotton Candy Custom Creations & Gifts and its owners from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the store, or content you submit.

These Terms are governed by and construed in accordance with the laws of the province or territory in Canada in which Cotton Candy Custom Creations & Gifts is established, and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located there for any dispute that is not subject to mandatory local consumer-protection law.

We may update these Terms from time to time. Changes take effect when posted on this page, and the “Last updated” date above will be revised. Your continued use of the store after changes are posted means you accept the updated Terms.
